Welcome to Yan. In these Terms, “we,” “us,” and “our” refer to the operator of the Yan product and clearyan.com. The seller of record for your purchase will be identified on the checkout page and your payment receipt. By downloading, installing, or using Yan, you agree to these Terms and our Privacy Policy.

1. Scope of Service

Yan is a desktop application centered on real-time voice input. It also provides local file transcription, transcription history, dictionaries, model management, and other supporting features. Core speech recognition runs locally. Some licensing, update, model download, purchase, and support features require an internet connection.

2. Your Content and Local Data

Your recordings, audio files, and transcripts remain yours. Yan does not upload them to our servers or use them to train models. You are responsible for backing up and managing your local data and for obtaining all rights and consents necessary to record, transcribe, or use any content.

Transcription accuracy may vary depending on background noise, accent, language, device, and model. You should manually verify medical, legal, financial, contractual, or other important content.

3. Software License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use Yan for personal or commercial purposes, including internal use within an organization. Licenses are assigned per device, and each trial or paid license may be activated on one device. A trial license remains valid for seven calendar days after activation. A paid license is purchased for a one-time fee, remains valid indefinitely, and includes lifetime updates at no additional charge. Pricing, supported platforms, device limits, upgrade entitlements, and seller information are as stated at checkout.

4. Restrictions

  • You may not bypass license validation, distribute license keys, or copy, sell, rent, or sublicense Yan without authorization.
  • Except to the extent expressly permitted by applicable law, you may not crack, decompile, or reverse engineer Yan.
  • You may not interfere with or misuse licensing, update, download, payment, or website services, or engage in fraud.
  • You may not record or transcribe content involving other people without obtaining any required consent, or use Yan to violate privacy, intellectual property, or other legal rights.
  • You may not use Yan for unlawful activities.

5. Third-Party Services

Yan may rely on third-party service providers for website hosting and security, trial and license administration, checkout and payment processing, software updates, and model distribution. Your use of those services may be subject to their respective terms and privacy policies. These online processes do not transmit your voice, audio files, or transcripts. 6. Purchases, Refunds, and Deactivation

Purchases made through Yan's official checkout are subject to the prices, taxes, and payment methods shown at checkout. If you purchase an individual, one-time license through the official Yan checkout, you may request a refund within 14 days of purchase in accordance with the Refund Policy, without giving a reason. Before requesting a refund, deactivate the license while connected to the internet by going to Settings > License in Yan. If the device is unavailable or deactivation fails, contact us for assistance.

7. Intellectual Property

Except for your content, all rights in the Yan software, brand, interface, documentation, and bundled resources belong to their respective owners. Third-party models and components are subject to their respective licenses. We may use feedback you provide to improve Yan without compensation, but doing so does not transfer ownership of your voice or transcripts to us.

8. Disclaimers and Liability

Yan is provided “as is.” We do not guarantee that Yan will operate without interruption or error or be suitable for every purpose. We are not liable for indirect or consequential losses arising from transcription errors, device failure, or failure to back up local data. Our total aggregate liability will not exceed the amount you paid for the license.

9. Termination

9.1 Termination by You

You may stop using Yan and uninstall it at any time. A trial license ends automatically when the trial period expires. Any refund is governed by our Refund Policy and applicable law.

9.2 Termination by Us

We may suspend or terminate your license if you materially breach these Terms, such as by bypassing license checks, distributing license keys, committing fraud, or using Yan for unlawful activities. Unless immediate action is necessary to prevent harm or unlawful conduct, we will provide notice where reasonably practicable.

9.3 Discontinuation of the Product or Online Services

If we discontinue Yan or related online services because of legal requirements, force majeure, or business changes, we will aim to provide at least 30 days' advance notice on our website. Your right to use a version you purchased will remain in effect, but online services such as activation, updates, model downloads, and support may become unavailable.

10. Changes to These Terms

We will publish revised Terms and their effective date on this website. Changes to these Terms will not retroactively reduce rights expressly granted under a paid license, except where required by law.
